EALA Speaker, Members Join Court Contest Over Election to Regional Assembly

The First Instance Division of the EACJ has granted leave to Hon. Margaret Nantongo Zziwa, Speaker of the East African Legislative Assembly, and eight other EALA Members from Uganda to appear as interveners in a case in which Uganda’s shadow Attorney General Hon. Abdu Katuntu wants the Court to declare that the rules of procedure pertaining to their election were contrary to the EAC Treaty.

In Court today however, EALA Speaker Hon. Zziwa and Uganda’s other eight representatives to the regional parliament applied to be allowed as interveners, saying they would restrict themselves to opposing the matter and would argue that the rules of procedure of the Parliament of Uganda were in consonance with the Treaty.

The Respondents in the case—Uganda’s Attorney General represented by Ms. Robina Gureme Rwakoojo and four others and Hon. Wilbert Kaahwa, Counsel to the Community representing the EAC Secretary General, consented to the application.
The Court will inform the Parties on the dates for the hearing in due course.

About the EACJ
The East African Court of Justice (EACJ or the Court), is the judicial arm of the East African Community established under Article 9 of the Treaty for the Establishment of the East African Community.

Operationalized in November 2001, the Court’s major responsibility is to ensure the adherence to law in the interpretation and application of and compliance with the EAC Treaty.

Arusha is the temporary seat of the Court until the Summit determines its permanent seat. The High Courts of the Partner States serve as sub-registries.
